These days, it’s common to see Delta-8 products in Texas smoke shops and even gas stations. However, many may not know that in 2021, the Texas Department of State Health Services (DSHS) attempted to ban Delta-8.
The ban was halted by legal challenges, but the case has now reached the Texas Supreme Court, which will determine if DSHS has the authority to implement such a ban.
The Houston Chronicle, explains that the court’s timeline is uncertain. “The Texas Supreme Court doesn’t follow a set schedule,” Tomlinson said, adding that a decision could be expected within a few months.
If DSHS is permitted to move forward with the ban, it would outlaw Delta-8 products like gummies and oils. “Essentially, anything you ingest that gives a pleasant sensation would become illegal,” media reporters noted, though CBD-based products would not be affected.
According to the Texas Hemp Business Council, hemp-derived cannabis products, including Delta-8, contribute $8 billion annually to the Texas economy.
A local smoke shop employee told media that many businesses like his would likely close if the ban is enforced.
